FOODS & FRUITS (the “Service”) and/or www.foodsnfruits.com (the “Website”) is operated by Friendship Enterprise Pte Ltd (the “Company”). Throughout the website and this Terms and Conditions, the term “we”, “us” or “our” refer to Friendship Enterprise Pte Ltd and FoodsnFruits.com
Users refers to a user who registers for an account with us for use of the Services (individually and collectively, “Users”, “you” or “your”).
By visiting the Website and/or purchasing products/goods from the Service, you agree that you have read, understood, and agreed with the Company’s policy. If you do not agree, please stop using the Service. The Agreement constitutes a legal agreement between you and the Company. In order to use the Service, you must agree to the Agreement including those additional terms and conditions and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.
The headings used in this agreement are included for convenience only and will not limit or otherwise affect the Agreement.
The Company functions as merchants (“Sellers”) to the users of the website (“Customers”) and facilitate the transportation of these purchases via in-house or third party delivery providers (“Drivers”).
The Company reserves the right to modify, vary or update the details of Agreement or its policies relating to the Service at any time. Such changes to the Agreement policies relating to the Service shall be effective upon the posting of an updated version.
2. THE SERVICE
The Service constitutes a technology platform that enables the website to arrange and schedule purchase of products or goods and its transportation to the Customer. When you place an order for products and goods on the website (“Order“), the Service acts as an agent to facilitate, process and conclude the order and subsequently deliver your Order to you.

Access to the Service
By using the website operated by the Company, you acknowledge and agree to be bound by the Agreement, and any future modifications and additions to this Agreement as published from time to time at https://www.foodsnfruits.com.
You agree that it is your responsibility to regularly review this Agreement whereupon the continued use of the Service after any such changes, whether or not reviewed by you, shall constitute your consent and acceptance to such changes.
Use of the Service
In order to use the Service, you must register for and maintain an active account. You must be at least eighteen (18) years of age to obtain an account.
You shall give the Company with proof of identity when it is reasonably requested or required.
You agree to provide accurate, current, and complete information as required for the Service and keep it updated. You agree that the Company may rely on your information as accurate, current and complete. You acknowledge that if your information is inaccurate, not current, or incomplete, the Company has the right to terminate the Agreement and your use of the Service at any time with or without notice.
You shall keep confidential and secure your account password or any private data which allows access to the Service. You shall not authorize others to use the identity. You are solely responsible for keeping your password safe. Save for cases of fraud or abuse which are not your fault, you accept that all Orders placed under your account are your sole responsibility.
The Service shall not be liable for Orders that encounter delivery issues due to incomplete, incorrect or missing information provided by you. You are obliged to provide information that is complete, accurate and truthful for the proper processing of your Order, including your delivery address and contact information.
If you wish to delete your account, please send us an email requesting the same. We may restrict, suspend or terminate your account and/or use of the Website if we reasonably believe that someone other than you is using your account or where you are suspected or discovered to have been involved in any activity or conduct that is in breach of these Terms, our policies and guidelines, or involved in activity or conduct which we deem in our sole discretion to be an abuse of the Website.
The Service will reasonably endeavour to comply with your special requests for your Order. However, in some cases where this is not feasible, possible or commercially reasonable, the Service reserve the right to proceed to prepare your Order in accordance with standard operating procedures. The Service shall be responsible to replace or refund an Order which does not conform to special requests provided by you.
The Service is not obligated to provide ingredient information or allergen information on the Website. Further, the Service does not guarantee that the goods sold are free of allergens, unless otherwise required by applicable laws.
The Service delivery representatives reserves the right to leave your Order at your doorstep if he was unable to reach you at your provided contact number and there is no one present or available to receive the Order. The Service is not responsible for the deterioration of goods or loss of Order if your Order was left at your doorstep as a result of you being uncontactable/not present or available to receive the Order.
Your order may be brought back to our facility or disposed in cases where we attempt to deliver an Order to you but are unable to do so due to reasons caused by you, including but not limited to (“Failed Delivery“):
(i) no one was present or available to receive the Order
(ii) lack of correct/appropriate or sufficient access to deliver the Order successfully
A redelivery fee of S$10.00 applies when you opt for the Order to be re-delivered to you. However, the Service will not be responsible for any deterioration in the quality and freshness of the products in such cases. The Service reserves the right to deny re-delivery request and/or dispose the order without refund or remedy to you in cases of Failed Delivery.
Upon receipt of your Order, if you discovered that there are issues with your Order (eg. wrong order, missing items, defective items), please immediately contact customer support via [email protected]. In some cases, the Service may request for photographic proof and/or additional information to properly investigate the issue with your Order. If we determine that the Order and/or Goods received are not of satisfactory condition or quality, we will compensate you for in full or partially in a refund via your original payment method and/or voucher credits.
3. PAYMENT AND TAX
Payment is accepted in full only via PayNow by scanning the QR code when checking out the shopping cart. Payment by credit card and/or debit card is not available.
You agree that the Agreement shall be subject to all prevailing statutory taxes, duties, fees, charges and/or costs.
From time to time, the Service may run marketing and promotional campaigns which offer voucher codes, discounts and other promotional offers. Vouchers are subjected to validity periods, redemption periods and in certain cases, may only be used once.
Vouchers may not be valid when used in conjunction with other promotions, discounts or other vouchers. Additional terms and conditions may apply to Vouchers.
Vouchers are non-redeemable and non-exchangeable for cash. The Service reserves the right to void, discontinue or reject the use of any Voucher without prior notice to you.
Discounts from voucher codes are apportioned and applied evenly across all products in your shopping cart during purchase. When you receive a refund for an item which was purchased using a voucher code, only the final paid price (ie. discounted price) will be refunded.
4. ACCURACY, COMPLETENESS AND TIMELINESS OF INFORMATION
The Company is not responsible if information made available on this site is not accurate, complete or current. The material on this site is provided for general information only and should not be relied upon or used as the sole basis for making decisions without consulting primary, more accurate, more complete or more timely sources of information. Any reliance on the material on this site is at your own risk.
This site may contain certain historical information. Historical information, necessarily, is not current and is provided for your reference only. The Company reserves the right to modify the contents of this site at any time, but The Company has no obligation to update any information on our site. You agree that it is your responsibility to monitor changes to our site.
5. MODIFICATIONS TO THE SERVICE AND PRICES
Prices of the products listed on the Website are subject to change without notice.
The Company reserves the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time.
The Company shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service.
6. PRODUCTS OR SERVICES
Certain products or services may be available exclusively online through the website. These products or services may have limited quantities and are subject to return or exchange only according to our Returns and Exchange Policy.
The Company has made every effort to display as accurately as possible the colours and images of products that appear on the Website. The Company cannot guarantee that your computer monitor’s display of any colour will be accurate.
The Company reserves the right, but is not obligated, to limit the sales of products or Services to any person, geographic region or jurisdiction. The Company may exercise this right on a case-by-case basis. The Company reserves the right to limit the quantities of any products or services that are offered. All descriptions of products or product pricing are subject to change at any time without notice, at the sole discretion of the Company. The Company reserves the right to discontinue any product at any time. Any offer for any product or service made on the Website is void where prohibited.
The Company does not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.
The weight of our products is within ±10% of the weight as printed on packages or on displayed on the website.
For any and all content containing health or nutritional information on our website, the information is intended only for education and not intended to be for medical purposes, treatment or diagnosis.
7. ACCURACY OF BILLING AND ACCOUNT INFORMATION
The Company reserves the right to refuse any order you place with us. In the event that the Company makes a change to or cancels an order, the Company may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made.
You agree to provide current, complete and accurate purchase and account information for all purchases made on our website. You agree to promptly update your account and other information, including your email address and contact number, so that the Company can complete your transactions and contact you as needed.

Certain content, products and services available via the Service may include materials from third-parties.
Third-party links on this site may direct you to third-party websites that are not affiliated with the Service. The Company is not responsible for examining or evaluating the content or accuracy and the Company does not warrant and will not have any liability or responsibility for any third-party materials or websites, or for any other materials, products, or services of third-parties.
The Company is not liable for any harm or damages related to the purchase or use of goods, services, resources, content, or any other transactions made in connection with any third-party websites.
Please review carefully the third-party’s policies and practices and make sure you understand them before you engage in any transaction. Complaints, claims, concerns, or questions regarding third-party products should be directed to the third-party.
9. ERRORS, INACCURACIES AND OMISSIONS
Occasionally there may be information on the Website or in the Service that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. The Company reserves the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information in the Service or on any related website is inaccurate at any time without prior notice (including after you have submitted your order).
The Company undertakes no obligation to update, amend or clarify information in the Service or on any related website, including without limitation, pricing information, except as required by law. No specified update or refresh date applied in the Service or on any related website, should be taken to indicate that all information in the Service or on any related website has been modified or updated.
10. DISCLAIMER OF WARRANTIES; LIMITATION OF LIABILITY
The Company does not guarantee, represent or warrant that your use of our service will be uninterrupted, timely, secure or error-free.
The Company does not warrant that the results that may be obtained from the use of the service will be accurate or reliable.
You agree that from time to time the Company may remove the service for indefinite periods of time or cancel the service at any time, without notice to you.
You expressly agree that your use of, or inability to use, the service is at your sole risk. The service and all products and services delivered to you through the service are (except as expressly stated by us) provided ‘as is’ and ‘as available’ for your use, without any representation, warranties or conditions of any kind, either express or implied, including all implied warranties or conditions of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.
In no case shall the Company, our directors, officers, employees, affiliates, agents, contractors, interns, suppliers, service providers or licensors be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including, without limitation lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability or otherwise, arising from your use of any of the service or any products procured using the service, or for any other claim related in any way to your use of the service or any product, including, but not limited to, any errors or omissions in any content, or any loss or damage of any kind incurred as a result of the use of the service or any content (or product) posted, transmitted, or otherwise made available via the service, even if advised of their possibility. You agree to indemnify, defend and hold harmless the Company and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of our in connection with (1) your violation or breach of any term of this Agreement or any applicable law or regulation, (2) your violation of any rights of any third party, (3) your use or misuse of the website and/or software, and (4) your ownership, use or operation of a vehicle.
In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.
You shall maintain in confidence all information and data relating to the Company, the service, and marketing/promotion plans. You shall ensure that you only use confidential information in order to perform the Service and shall not disclose information to any third party.
14. PRIVATE DATA PROTECTION
Third Party Interactions
During use of the Service, you may be exposed to promotions of third party providers, advertisers, and sponsors showing their services and/or goods through the Website. Any terms, conditions, representations, or warranties relevant to the activity is solely between you and the third party.
You shall recognize that third party may require your agreement to additional or different terms and conditions prior to your use of its service and/or goods, and the Company is not responsible for any of agreements between you and the third party.
If you do not want to receive any advertisement from the third party, you should notify us in writing.
The Company may give you notice on the website, to your email address, and/or to your address in the record you provided to the Company.
The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.
These Terms of Service and any policies or operating rules posted by us on this site or in respect to the Service constitutes the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service).
Any ambiguities in the interpretation of these Terms of Service shall not be construed against the drafting party.
The Agreement shall be governed by Singaporean law.
You agree that the Company may terminate the Agreement at any time by giving three (3) days’ prior notice to you without any reasons.
No joint venture, partnership, employment, or agency relationship exists between you, the Company, or any third party provider as a results of the Agreement or use of the Service.
If any provision of the Agreement is held to be invalid or illegal, such provision shall not be affected.
Free island-wide delivery for order above S$100.00 and flat rate of S$10.00 per location will be levied.
Express delivery can be arranged @ S$35.00 per location.
There will be an additional charge of S$15.00 for delivery to Central Business District (CBD Areas), Sentosa, Jurong Island, Changi Airport, seaports and military bases. This additional charge will also be applicable for redelivery and express delivery.
Order received will be scheduled for delivery a day after the order is received unless a rescheduled delivery is arranged.
Delivery schedules are from Mondays to Saturdays, between 2 – 9 pm. No delivery on Sundays and Public Holidays.
If you changed your mind and would like to cancel the order, please inform us one (1) day in advance with your order number via email ([email protected]) or WhatsApps (+65 8600 7223) before the scheduled delivery date otherwise, no refund will be made once we proceed with packing your order.
Any cancellation and refunds agreed upon will be processed within 7 working days.
Returns and Exchange Policy
Due to perishability of fresh items, our refund and exchange policy lasts for 24 hours. If 24 hours have gone by since the receipt of your items, we can’t offer you a refund or exchange.
The Company reserves the right to exchange your items for a similar product in type or in value in the event of an exchange and your items are not available, otherwise we will proceed to refund to you the values of your items.
We will notify you via email once your request for refund is investigated and approved.
Refunds will be processed within 7 working days upon approval.
